Access to and use of this website, as well as the purchase of products or services through it, implies full and unreserved acceptance of these Terms and Conditions.
2. Scope of Application
These Terms and Conditions govern:

All content made available on the website, including texts, images, photographs, videos, illustrations, logos, trademarks, graphic design, and educational materials, is the property of ONWILD® or used with authorization from the respective rights holders and is protected by copyright and other applicable legislation.
Informational or editorial content, namely blog articles, is provided for informational and educational purposes only and does not replace technical, scientific, or professional advice.
4. User Registration and Account

The user undertakes to provide truthful, complete, and up-to-date information and is responsible for maintaining the confidentiality of their access credentials.

5. Products and Services
5.1 Digital Products

Specific conditions regarding access, use, returns, and refunds for digital products are defined in the Digital Products Policy and the Returns and Refunds Policy, which supplement these Terms and Conditions.
5.2 Physical Products
Physical products include, among others, books, clothing, merchandising, and other tangible goods.
Conditions applicable to shipping, returns, and refunds are defined in the Returns and Refunds Policy.
5.3 Services, Workshops, and Training
ONWILD® provides in-person and/or online services and experiences, including workshops, field outings, training courses, tutorials, and other activities related to wildlife photography and biology.
Each service may have specific conditions, including dates, locations, minimum number of participants, physical or technical requirements, and cancellation policies, which are duly indicated on the respective service page.
6. Prices and Payments
All prices displayed on the website include VAT at the legally applicable rate, unless otherwise stated.
ONWILD® reserves the right to change prices and commercial conditions at any time, without prejudice to orders already confirmed.
Payment must be made using the payment methods made available on the website at the time of purchase.
7. Intellectual Property and Use of Content
The purchase of digital products or participation in services and training grants the client a personal, non-exclusive, and non-transferable licence of use.
It is expressly prohibited to reproduce, copy, distribute, resell, publicly share, or commercially use the content, in whole or in part, without prior written authorization from ONWILD®.
Photographs displayed on the website may not be used, reproduced, or downloaded for commercial or editorial purposes without a licence or prior authorization.
8. Liability
ONWILD® makes its best efforts to ensure that the information provided on the website is current and accurate but does not guarantee the absence of errors or omissions.
ONWILD® is not liable for damages resulting from service interruptions, technical failures, viruses, or improper use of the website.
In the case of workshops and field activities, participants acknowledge that these involve inherent risks associated with outdoor activities and undertake to comply with all safety guidelines provided by ONWILD®.

In the event of a dispute, and failing amicable resolution, jurisdiction lies with the legally competent court, with express waiver of any other.

DIGITAL PRODUCTS POLICY
1. Scope
This Digital Products Policy applies to the purchase and use of digital products made available on the ONWILD® website, including but not limited to online courses, digital training, e-books, downloadable files (PDFs, videos, presets, guides, among others), and other digital content.
By purchasing a digital product through the ONWILD® website, the customer declares that they have read, understood, and fully accepted the terms of this policy.
2. Nature of Digital Products
Digital products marketed by ONWILD® consist of content provided in digital, non-physical format, with access made available via download, access to an online platform, or delivery by email, as applicable.
After payment confirmation, access to the digital product is granted automatically or manually, depending on the type of product purchased.
3. Prices and Payments
All prices displayed on the website include VAT at the legally applicable rate, unless otherwise stated.
Payments may be made using the payment methods available on the website at the time of purchase. ONWILD® reserves the right to change prices and commercial conditions at any time, without prejudice to confirmed orders.
4. Right of Withdrawal
Under Decree-Law No. 24/2014 of 14 February, the consumer has a period of 14 days to withdraw from the contract.
However, the right of withdrawal does not apply to contracts for the supply of digital content not provided on a tangible medium when:

Performance has begun with the consumer’s prior and express consent; and

The consumer acknowledges that they lose their right of withdrawal once the supply of the digital content has begun.
By completing the purchase of a digital product on the ONWILD® website, the customer expressly agrees to the immediate supply of the digital content and acknowledges the loss of the right of withdrawal.
5. Access and Availability
ONWILD® undertakes to ensure access to purchased digital products under the terms and for the period indicated in the description of each product.
Where applicable, access to online course platforms may be subject to time or technical limits, duly identified on the product page.
ONWILD® is not responsible for access difficulties resulting from technical issues attributable to the user, including internet connection problems or incompatible equipment or software.
6. Intellectual Property
All digital products made available by ONWILD® are protected by copyright and other intellectual property rights.
The purchase of a digital product grants the customer a personal, non-exclusive, and non-transferable licence of use. It is expressly prohibited to:

Reproduce, copy, modify, or distribute the content;

Resell, transfer, share, or make the products publicly available;

Use the content for commercial or training purposes without written authorization from ONWILD®.
Any unauthorized use may give rise to civil and/or criminal liability.

Some digital products, particularly online courses, may be subject to updates, improvements, or changes over time.
ONWILD® reserves the right to modify or update content while maintaining consistency with the educational and informational objectives of the originally purchased product.
8. Liability
The digital content provided by ONWILD® is informational and educational in nature, based on the professional experience of the author as a wildlife biologist and photographer.
ONWILD® does not guarantee specific results from the application of the knowledge acquired and cannot be held responsible for decisions made based on the content provided.

10. Policy Amendments

RETURNS AND REFUNDS POLICY
1. Scope
This Returns and Refunds Policy applies to all purchases made through the ONWILD® website, covering digital products and physical products such as clothing, books, merchandising, and other tangible goods.
By making a purchase on the ONWILD® website, the customer declares that they have read, understood, and accepted the terms of this policy.
2. Digital Products
2.1 Nature of Digital Products
Digital products provided by ONWILD® consist of non-material content such as online courses, e-books, videos, PDF files, digital guides, presets, and other downloadable or platform-accessible content.
2.2 Right of Withdrawal
Under Decree-Law No. 24/2014 of 14 February, the consumer generally has a period of 14 days to exercise the right of withdrawal.
However, no returns or refunds are accepted for digital products not supplied on a tangible medium when:

The supply of the digital content has begun with the consumer’s prior and express consent; and
-
The consumer acknowledges that they lose the right of withdrawal once the supply of the digital content has begun.
By completing the purchase of a digital product on the ONWILD® website, the customer expressly accepts the immediate supply of the digital content and acknowledges the loss of the right of withdrawal. No refund is due after access to the content has been granted.
2.3 Exceptions
On an exceptional basis, cases of proven technical impossibility of accessing the digital product attributable exclusively to ONWILD® may be assessed, in which case one of the following may be granted:

Restoration of access to the content; or
-
Alternatively, a refund of the amount paid.
3. Physical Products
Physical products marketed by ONWILD® include, among others, clothing, books, merchandising, and other tangible goods shipped to the address provided by the customer.
3.1 Right of Withdrawal
Under Decree-Law No. 24/2014 of 14 February, the consumer has a period of 14 consecutive days from the date of receipt of the physical product to exercise the right of withdrawal, without the need to provide any reason.
3.2 Conditions for Returns
To be accepted, returned physical products must cumulatively meet the following requirements:

Be in perfect condition;

Show no signs of use, washing, or damage;

Be returned with all components, labels, and original packaging, where applicable.
Returns of personalized physical products or products made specifically to order are not accepted, except in cases of defect or error attributable to ONWILD®.
3.3 Return Costs
Shipping costs associated with the return of physical products are the responsibility of the customer, except where:

The product has a manufacturing defect;
-
The product sent does not correspond to the order.
In such cases, ONWILD® will bear the return costs.
3.4 Refunds
After receipt and verification of the condition of the returned product, ONWILD® will refund the amount paid for the product, excluding shipping costs, within a maximum period of 14 days, using the same payment method used in the initial transaction, unless otherwise expressly agreed.
4. Returns and Refunds Procedure
Any request for return or refund must be made in writing through the contact details provided on the ONWILD® website, indicating:

Customer name;

Order number;
-
Product purchased;
-
Reason for the request (where applicable).
ONWILD® will review the request and respond as soon as possible.
5. Order Cancellations
After payment confirmation and the start of supply of a digital product, order cancellation is not possible.
For physical products, cancellation is only possible before the order is shipped.
6. Liability
ONWILD® reserves the right to refuse return or refund requests that do not comply with the requirements set out in this policy.
7. Policy Amendments
ONWILD® reserves the right to amend or update this Returns and Refunds Policy at any time. Amendments take effect from the date of publication on the website.
